This contract is between Log On Limited (The Company) herein called “The Company” and all persons who use the site known as “ Caribbean Resumes” (hereinafter called “CR”) which said site is owned wholly and operated by The Company. It is expressly stated that all persons using this site shall be bound by the terms and conditions hereinafter contained. In this contract “service” refers o the service provided by this site. Your use of this service is at your own risk. The service is provided on an “as is” and “as available” basis and The Company and its' subsidiaries, agent and or parties and licensors expressly disclaims all warranties of any kind whatsoever expressed or implied and shall not be liable for the truth and/or accuracy of any information posted on this site. This contract and any dispute arising there from shall be governed by the laws of Trinidad and Tobago and all litigation shall be conducted in Trinidad and Tobago. Job seekers The Company owns all content submitted. Information is kept confidential but The Company maintains the right to disclose such information if needed by law. Only Administrators of CR and only employees of The Company reserves the right to contact each job seekers by using ANY information entered on the site. The Company maintains the right to collect personal information on the site through the use of cookies and other means. When you register The Company asks for information such as your email address, birth date, gender, occupation, industry, and personal interests. When you register with CR and sign in to our services, you are not anonymous to us (CR/The Company) but you will be anonymous to employers and job seekers may be contacted by The Company using information entered on the site. CR automatically receives and records information from your computer and browser, including your IP address, cookie information, software and hardware attributes, and the page you request. CR uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients. You are at least 18 years or over CR does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you've requested, when The Company has your permission, or under the following circumstances: The Company provides the information to trusted partners who work on behalf of or with CR under confidentiality agreements. These companies may use your personal information to help CR communicate with you about offers from CR and our marketing partners. However, these companies do not have any independent right to share this information. The Company responds to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. The Company believes it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of CR's terms of use, or as otherwise required by law. The Company transfers information about you if CR is acquired by or merged with another company. In this event, CR will notify you before information about you is transferred and becomes subject to a different privacy policy. The Company reserves the right to send you certain communications relating to the CR service, such as service announcements, administrative messages and the CR Newsletter, that are considered part of your CR account, without offering you the opportunity to opt out of receiving them. CR may update this policy from time to time without notice to you. Member, Account and password security: You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify CR of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. CR cannot and will not be liable for any loss or damage arising from your failure to comply with this. MEMBER CONDUCT You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not CR/The Company, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. CR/The Company does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will CR/The Company be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service. You agree to not use the Service to: 1.upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; 2.harm minors in any way; 3.impersonate any person or entity, including, but not limited to, a CR or The Company official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity; 4.forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service; 5.upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); 6.upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party; 7.upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping) that are designated for such purpose. 8.upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; 9.disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges; 10.interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; 11.intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law; 12.provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act; 13."stalk" or otherwise harass another; and/or 14.collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through m above. NO RESALE OF SERVICE You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service (including your CR ID), use of the Service, or access to the Service. TERMINATION You agree that CR may, under certain circumstances and without prior notice, immediately terminate your CR account, any associated email address, and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Termination of your CR's account includes (a) removal of access to all offerings within the Service, including but not limited to Resume posting service, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in CR's sole discretion and that CR shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service. LINKS The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because CR has no control over such sites and resources, you acknowledge and agree that CR is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that CR shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. The Company AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. On registration job seekers will be required and/or requested to provide the Company with certain information. Notwithstanding the site privacy policy, you agree that the Company may disclose to third parties, on an anonymous basis, some of the material provided by you when you register or which you enter in to your account. The Company will enable employers and employment agencies which have paid to view resumes to be given certain contact details of users who have posted resumes on the site. These details and your identity will not be made available to the recruiter until you respond to a recruiter's request. However this information will be disclosed if you respond to an email sent by the Employer. The Company will not otherwise disclose to any third party your name, address, e-mail address or telephone numbers without your prior consent unless such disclosure is required by law. Users may not: a/ Post content about any business opportunity which requires an up-front or periodic payment, which pays commissions only, or which requires recruitment of other persons or sub-agents or sub-distributors; b/ post any false, inaccurate or misleading content on the site; c/ post a resume which is not the user's own resume; d/ delete or alter any content placed on the site by any other person or user; e/ reveal any password provided to you for accessing non-public areas of this site to any other person or user; f/ use or attempt to use any method including any software, spider, robot, avatar, intelligent agent, tool, for searching or navigating this site other than the methods provided by the Company on the this site. g/ attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the site; h/ post chain letters or content about any pyramid schemes, franchise, "club membership", or distributorship; i/ post content about business opportunities or soliciting business or inducing people to engage in business; j/ impersonate another person; k/ use the site for the purpose of building up a database of potential employers that you or any other person intends to exploit for any commercial purpose. Any content discovered to be in breach of these Ts & Cs which has been loaded on to this site may be removed if the fact is notified to the Company and no recompense shall be owed to the user who loaded it on to the site.   Any breach as described or similar which may result in civil or criminal liability will enable the Company to prosecute anybody or assist with the prosecution of anybody who attempts or who carries out such activities Keeping Your Log-In Details Secret You hereby undertake to keep all details necessary for logging in to your account confidential. You hereby agree to notify the Company of any unauthorised use of the details required for logging in to your account and of any unauthorised use of your account. - Definitions "Contact details" - email address, telephone numbers and postal address   General CR reserves the right to amend this privacy statement at any time.   Account and Resume information Your CR account containing your contact details and your resume will be made available for searching and viewing over the Internet by recruiters (employers and employment agencies) who have paid to access such information. You email address is not considered part of the contact details. Bear in mind that your current employer may be a recruiter who is a customer of CR, or a client of one of our customers who is a recruiter. CR cannot be held responsible for any consequence from the viewing of your contact details and resume. The Company will not share your name or email address with employers at any point, however employers may contact you via an anonymous contact form that goes to your email. If you respond to this email, it will go directly to the employer's inbox and you acknowledge the fact that at this point, your identity is revealed to the employer via your email name and email address. If you choose to create or upload a resume to our database and include your contact details you will be making such information available to all recruiters who are customers of CR and you are entirely responsible for any consequences.   Account Deletion You can contact CR by using the Contact form on the CR website and ask for your account to be removed. Also your resume will auto expire after a set time (determined by CR). A few days before this expiratory time, you will be sent an email asking if you would like to extend. Job Alerts The Job Alerts service matches job seekers with vacancies advertised on the CR website. Job seekers who post their resume will receive an email containing details of jobs that CR believes that job seekers may be interested in. Once you post a resume you acknowledge the fact that CR will send you periodic job alerts. Keeping Your Information Up to Date You should update your account (contact details and resume) at least every six months. Once your profile is our database The Company will contact you after a specified time (determined by CR) using your most recent contact details to ask whether you want it to remain on the site. If The Company does not hear from you, your account may be suspend but not entirely removed from our database. Please note that The Company reserves the right to remove from our database resumes and jobs which include any content that The Company considers to be offensive or illegal or in the event that a complaint is made where The Company considers that the complaint has merit.   Aggregation of Information CR may aggregate information about users of the website to identify employment trends across different industries such as the number of graduates looking for jobs in particular sectors, and the total number of employers in a particular category advertising jobs. The Company may make such information publicly available. Information about individual users will not be made available. The Company also provides aggregate statistical information about site users to recruiters, advertisers, suppliers and other reputable third parties such as the number of visitors to the site. Again, The Company will not provide information on individual users of this site.   Security The site is protected by security process that The Company cannot disclose. Transactions are secured using an SSL certificate to encrypt information. Credit card transactions are handled entirely by PayPal If your credit card information is compromised at any time, CR/The Company will not be held responsible for this and this can be taken up with paypal. Contacting You About the Operation of the Site or With Marketing Material The Company may contact you at any time to inform you with information relevant to the operation of existing aspects of services on the site.   The Company has the right to send marketing information to you about new or related services or to offer third party services and products if you have indicated that this is permitted when you register or at any later time. Recruiters/Employers - you cannot use the website and its content to conduct fraudulent activities or harassment of job seekers. CR/The Company grants users who are posting jobs a personal, non-transferable and non-exclusive right to access and use the site solely for their own personal use in connection with seeking qualified candidates for jobs within their organisation, or for jobs within client companies. A posting shall relate to a single employment opening only. “Job Posts” should only be about job vacancies at the company and not anything else (like services offered etc) Keeping Your Log-In Details Secret You hereby undertake to keep all details necessary for logging in to your account confidential. You hereby agree to notify the Company of any unauthorised use of the details required for logging in to your account and of any unauthorised use of your account. Responsibility for Resume and Job Postings Material You hereby agree that you are solely responsible for all content and formatting of your resume or job postings including the accuracy and completeness of all information therein that you post on this website.   CR is not responsible in any way for employment decisions taken by any person of any description.   CR is not acting or to be considered as acting as an employer or an employment agency with respect to your use of the site. - Service Availability and Your System and Equipment Security The Company does not warrant that this site will operate error-free. The Company does not warrant that the site and its server or any associated facility, equipment or services are free of computer viruses, worms, infiltration software or other harmful devices of any sort. If your use of this website or the content obtained from it results in the need for servicing or replacing equipment or content, interruptions or delays, the Company is not responsible for those costs or any other consequences. This website and content are provided on an "as is" basis without any warranties of any kind. The Company, to the extent permitted by law, disclaims all warranties express or implied including the warranties of merchantability, fitness for purpose and non-infringement. The Company makes no warranties about the accuracy, reliability, completeness or any other quality of the content, links, services or other aspects of the site. The Company will try to ensure that this site is available to users of the world wide web for as much time as is reasonably possible. However, at times the site may be partially or completely unavailable due to the need to make improvements, to undertake maintenance, due to technical faults or for reasons beyond our control such as failures by third party service providers or an actual or a risk of virus or other attack. You agree that The Company shall have no financial liability to you in the event of such unavailability. Disclaimer of Consequential Damages and Speculative Loss In no event shall the Company, its directors, suppliers, associates, affiliates, employees, and any third party mentioned on the site, in circumstances including but not limited to negligence, be liable in any way including, without limitation, exemplary, special, punitive, incidental and consequential damages, speculative loss, lost profits, loss of future earnings, prospects, or damages resulting from lost content or business interruption as a result of the use or the inability to use this site and the content on it, whether based on warranty, contract, tort or any other legal mechanism and whether or not the Company is advised of the possibility of such damages. No Resale or Unauthorised Commercial or other Use You hereby agree not to assign or resell your rights or obligations under these Ts & Cs. You agree not to make any unauthorised commercial use of the Website. - Limitation of Liability The aggregate liability for the Company to an employer or employment agency for all claims arising from the use of the contents is limited to $100 Trinidadian dollars. The Company has no liability to other users. Users acknowledge and agree that the Company shall not be liable for any defamatory, offensive, hateful or illegal conduct of any user. -Termination The Company reserves the right, at its sole discretion, to use all of its legal remedies, including but not limited to immediate termination of your account, denial of access to the site and of any other service provided by the Company, and deletion of any content posted by you, in the event that you breach any of these Ts & Cs or if the Company is unable to verify the accuracy of any content that you submit to the site. - Indemnity You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees and agents from and against any claims, actions or demands (in negligence or otherwise), including without limitation reasonable professional fees, allegedly resulting or actually resulting from your use of the site content an/or services, or your breach of the terms of these Ts & Cs or related in any way to any user's conduct towards any other user of the site. - Cancellations and Refunds Policy In the event that the services provided by the company do not meet with their description, then the company will refund to you any monies paid either direct to your credit card if you have paid by card, or by cheque or cash if you have paid by cheque or cash. To qualify for a refund you must provide the company within 2 working days of the commencement of your contract, or the contract renewal date, with your reasons for believing that the services provided do not meet with their description. If the company agrees with your reasons (CR/The Company determines this) then you shall be refunded in the manner described. Our Credit Card transactions are maintained by the leading Internet credit cad processing company PayPal. PayPal uses industry leading 128-bit encryption VeriSign technology. All information sent via VeriSign is encrypted. No refund shall be given for a period less than 7 days during any calendar month, if such problems persists for a longer period greater than 7 days, a refund will be made on a pro active basis for the number of days in excess of the day period, during which such problems persist with the site. For everyone The Company has the right to contact users at any time with information relevant to the operation of existing aspects of the services on the site. Loss of Material The Company is not responsible for any loss of content that users post on the site and users shall be responsible for retaining in their possession sufficient quality and quantity of such materials for whatsoever purposes they may require including by way of back-ups. Ownership of the Site  The contents of this site are the property of the Company or its third party suppliers, or its clients according to its origin and/or agreements reached between the Company and third parties, and agreements reached between the Company and users according to these Ts and Cs, and are protected under copyright and trademark laws. The Company authorises you to download a single copy of the publicly available sections of the site solely for non-commercial use. Any such copy must retain all the content of the original. You may not use the contents in any way for any commercial or other public use. You may not copy, display, transmit or distribute any content from the site except as indicated above. Use of the site does not give you any proprietary rights in any intellectual property. - You may NOT transfer the contents of privileged information (like search results of the resume database) to anyone/any company what so ever. This will be an outright breach and your account/access will be removed immediately without refund. CR/The Company owns the right to disable a person's account at any time. Acceptable Use - Site Interference Users may not interfere or attempt to interfere with the legitimate use of the site by any person. The following non-exclusive list of activities are prohibited: i/ sending unsolicited email and/or unsolicited promotions; ii/ advertising products and services other than jobs; iii/ forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; iv/ posting anything which contains viruses, worms, trojan horses or anything else which is intended or might damage or impede the workings of the site or which is intended to or might intercept or expropriate any content or system. Any breach as described or similar may result in civil or criminal liability and the Company may prosecute anybody or assist with the prosecution of anybody who attempts or who carries out such activities. The Company makes no representations as to the truthfulness accuracy or reliability of any content posted by users. You acknowledge that reliance on content posted by other users is entirely at your own risk including, to the extent permitted by law, whether directly or indirectly due to the Company's negligence or otherwise, all opinions expressed by users. Right to Refuse Permission to Use the Site The Company reserves the right to expel and/or prevent users from accessing the site for breaching these Ts & Cs and/or the law. A Passive Conduit Only This site acts only as a passive conduit to enable users to publish to distribute and publish their text and other permitted information on-line and the Company is not obliged to screen content before it is posted on the site. The Company reserves the right, free of liability and free of responsibility to users, to remove any content from the site if it is notified by a user about material which has been posted on the site which allegedly is not in compliance with these Ts & Cs and/or the law. Company's Liability The site enables job seekers to post resumes and view career information and recruiters of any description to publish details of job opportunities and obtain recruitment information. The Company is not obliged to screen any content. The Company is not involved in the exchange between candidates and recruiters. Accordingly, the Company has no control over the legality, truthfulness, accuracy or reliability of the representations made, nor knowledge about the ability of candidates to accept offers of employment or competently undertake the jobs for which they are applying, nor any knowledge about whether it is safe to make contact with particular users, nor knowledge about whether recruiters are able to provide the jobs which they have advertised on the website, nor any control over the quality, safety, or legality or other quality of the resumes or jobs posted. You hereby acknowledge and accept any and all risks including but not limited to physical and economic harm, and of dealing with under-age persons as a result of contacting anybody through or with the aid of this site. You should clearly exercise all reasonable precautions when contacting any other user of this site or any other person with whom you have come in to contact through the use of this site either directly or indirectly. The Company does not confirm that a user is who the user claims to be. If you should have a dispute with one or more users you absolve the Company including any associated person, employee, agent, and entity from any claims or damages whether they be direct or indirect, actual or consequential of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed which are in any way connected with such a dispute, and you also waive any rights afforded by legislation which are permitted to be waived by law. The content on this site may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness or any other quality of the content. The use of this website and the content on it is entirely at your own risk including all information designed to help with career development and human resources operations. The Company does not represent in any way that an employer or employment agent will ask for a candidate's information, ask to interview a candidate or hire a candidate, or that any candidate will be available of or capable of meeting the needs of any employer, employment agency or client. Governed by Trinidad law and Trinidadian courts. Changes to Services The Company shall be entitled at anytime without notification to users to make changes to the services which are necessary to comply with any applicable security or other statutory requirement. - Additional Terms of Use Certain areas of this site are subject to additional terms of use. By using such areas, or any part thereof, you agree to be bound by the additional terms of use applicable to such areas. - If there are legal claims/battles, the opposing party will pay all legal fees on behalf of CR and The Company. there is 1 user account created for each paying company. 1 user account is directly associated with 1 username and password which must NOT be shared with any other company. This is a breach and if caught, immediately suspension of the account will take place with no refund. The username and password should only be used to log in at one computer at any one moment in time. The system can detect if this username and password is used to log in from difference computers and the system will automatically suspend this user if such activity is detected. If this happens, please contact CR for reactivation. Please note: CR will investigate as to why the account was blocked and if it was deemed that sharing of the username and password was evident, immediate suspension of the account with no refund will take place. If a company requires more than one user login and password, that company should call us to discuss further. CR reserves the right to treat each username and password separately as if it was different companies associated with each username/password. However this may not always be the case as The Company may be flexible in providing multiple usernames/password for a company with a large HR department. Your order history page is available when you login in and click on “my account”. This page will reflect your current charges and outstanding payments. CR/The Company must receive 100% of payments due before The Company can follow through with the service required. If by chance, employers discover a security flaw in the system and uses this flaw to access the system, once discovered, the said employer will be charged for the service that they have used. The normal (current) rates will apply subject to the discretion of CR/The Company. All flaw must be reported once discovered. If the employer feels that their password has been compromised from within their company, CR will replace this password with a new one. Please use our contact form. There will be no refund if the compromise is not due to CR's fault. During the period that the account may have been comprised, use of the account is deemed “normal use” and any job postings/searching will deemed to be normal behaviour. There will be no refund for any activities during the period that the account was compromised. It is solely the responsibly of the employer to protect their username/password.
